UGA police dismiss rape allegation against college student

After a year-long investigation, we were able to convince the UGA Police Department that our client's sexual encounter with the accuser was completely consensual.

Our client was a freshman at Georgia Southern and he came up to Athens to spend the weekend with some friends at the University of Georgia.

They attended the football game and some parties. They eventually made their way to a bar in downtown Athens. At the bar, our client met a girl who was a freshman at UGA.

Our client and the girl eventually left the bar together and walked back to her dorm room on campus. They had sex inside of her dorm room and our client eventually passed out in the hallway.

The next day, the girl claimed that he had sex with her without her consent. This was possibly due to the embarrassment of her roommates finding our client passed out (naked) outside their room.

The girl’s allegation was then investigated by the University of Georgia Police Department. We were hired just a few days later.

We immediately sent our client for a polygraph (which he passed) and provided the report to the investigator. That bought us some time to investigate and gather evidence.

We then obtained the Life360 data from our client’s phone that documented the route that he and the girl took on their walk from the bar to her dorm. With this information, we encouraged the investigator to identify and pull the campus video surveillance footage. The footage would show the two of them walking arm-in-arm and holding hands. At one point during their walk, they stopped to make out.

We provided the investigator with a written summary of our client’s version of events which included him describing a point during the walk where they both fell and he injured his elbow. This turned out to be an important piece of information.

The girl had apparently claimed that she sustained an injury during the alleged rape and pointed out some sort of cut or scrape that she had. This injury was clearly sustained from the fall on their walk.

We were then able to provide the investigator with pictures of the cut on our client’s elbow. This seemingly insignificant fact proved to be critical since it proved that our client’s story was accurate and the girls’ was not.

After an investigation that lasted a little over a year, the UGA Police Department dismissed the case prior to any arrest being made.

This allowed our client to stay in school as well as avoid any sort of mark on his criminal record.
